Welcome to Rubbo! This User Agreement ("Agreement") is a legal contract between you and Rubbo governing your use of our mobile application. By downloading, installing, or using Rubbo, you agree to be bound by the terms and conditions of this Agreement.
Rubbo is an all-in-one solution for photo management that combines smart organization with AI analysis. Our app allows you to automatically sort and categorize your photos, create encrypted albums for private moments, and gain insights through AI-driven photo analysis - all without requiring an account.
By using Rubbo, you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy. If you do not agree to these terms, please do not use our app.
You agree to use Rubbo only for lawful purposes and in accordance with this Agreement. You shall not use the app in any way that violates applicable federal, state, or local laws or regulations.
Specifically, you agree not to:
Rubbo and all content and functionality available through the app, including but not limited to software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by Rubbo or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use Rubbo for your personal, non-commercial use only. This license does not include any resale or commercial use of Rubbo or its contents, any collection and use of any product listings, descriptions, or prices, any derivative use of Rubbo or its contents, any downloading or copying of account information for the benefit of another merchant, or any use of data mining, robots, or similar data gathering and extraction tools.
You retain all ownership rights to your photos and other content that you upload or process through Rubbo. By using Rubbo, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the services you request, such as organizing, categorizing, and analyzing your photos.
Rubbo processes your photos locally on your device to the extent possible. Any processing that occurs on our servers is done securely and in accordance with our Privacy Policy.
RUBBO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RUBBO DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT RUBBO OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RUBBO OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE RUBBO; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON RUBBO; (iii) ANY CONTENT OBTAINED FROM RUBBO; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Rubbo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Agreement or your use of Rubbo, including but not limited to your User Content, any use of Rubbo's content, services, and products other than as expressly authorized in this Agreement, or your use of any information obtained from Rubbo.
This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
You agree that any legal action or proceeding between you and Rubbo shall be brought exclusively in the federal or state courts located in San Francisco, California, and you consent to the jurisdiction of such courts.
If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
You acknowledge that Rubbo is offering the app for download in reliance on your agreement to these terms, which reflect a reasonable and fair allocation of risk between you and Rubbo. Rubbo's limitation of liability is an essential part of this allocation and without it, the terms and prices offered would be different.
We may revise and update this Agreement from time to time. We will notify you of any material changes by posting the new Agreement on this page and by providing a notice within the app. Your continued use of Rubbo after any such changes constitutes your acceptance of the new terms.
We may terminate or suspend your access to Rubbo immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of this Agreement.
Upon termination, your right to use Rubbo will immediately cease. If you wish to terminate this Agreement, you may simply discontinue using Rubbo.
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Rubbo with respect to the use of Rubbo and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, with respect to such subject matter.
